1. 接受条款与适用范围
下载、安装、购买或使用拾纹，即表示你同意本服务条款。本条款适用于通过 Apple App Store 提供的拾纹 2.2.0，包括 iPhone、iPad，以及在 Mac 上运行的同一款 App。
本条款补充而不取代 Apple 标准最终用户许可协议（Standard EULA）。App 的许可、App Store 分发及 Apple 作为第三方受益人的相关事项同时受 Apple 标准 EULA 约束；发生冲突时，以 Apple 标准 EULA 及强制适用的消费者法律为准。
2. 服务内容
拾纹是一款本地优先的纹样创作工具。2.2.0 可导入或拍摄图片，使用 23 种图案结构进行取样和无缝平铺，选择配色及水彩、油画、拓印等画面风格，并使用本机 AI 高清和一键抠图。你可以保存本地项目，或导出单位图块、整图和透明 PNG（以具体功能与权益为准）。
当前版本不要求注册账号，也不提供云端项目同步。功能、界面、可用图案结构和系统要求可能随版本更新而调整。
3. App 使用许可
在你遵守本条款和 Apple 标准 EULA 的前提下，我们授予你有限的、非独占、不可转让的 App 使用许可。你不得复制、出售、出租、规避付费或安全限制、对 App 进行未经法律允许的逆向工程，或利用 App 干扰设备、服务或他人的合法权益。
4. 来源图片与输出作品
- 你保留对自己合法拥有的来源图片、取样内容、本地项目和输出作品的权利；拾纹不会因你使用 App 而主张这些内容的所有权。
- 你应确保自己有权导入、处理、分享和使用来源图片，包括其中的著作权、商标权、肖像权、隐私权及其他第三方权利。
- 拾纹提供的是创作工具，不保证输出具有独创性、可注册知识产权、彼此唯一，或一定不会与他人作品相似。
- 你能否将输出用于商业用途，取决于来源素材的许可、你的编辑贡献和适用法律。使用 App 本身不会替你取得来源素材的商业授权。
图片、抠图、AI 高清和纹样渲染在设备上完成，不会上传到拾纹服务器。详细的数据处理方式请查看《隐私政策》。
5. Pro 购买、订阅与恢复
- 拾纹可提供永久、月度和年度 Pro 方案。实际可用商品、价格、计费周期、试用或优惠资格，以购买时 App Store 和付费页显示的信息为准。
- 永久方案为一次性购买，不会自动续订。月度和年度方案为自动续期订阅，除非你在当前周期结束前至少 24 小时取消，否则会由 Apple 账户自动续费。
- 你可以在 Apple 账户的订阅设置中管理或取消订阅。删除 App 不会自动取消订阅。
- 购买、续费、退款、税费、试用与优惠码资格由 Apple 处理并受 Apple 条款约束。退款请求应通过 Apple 提交。
- “恢复购买”会根据 Apple 可验证的购买记录恢复权益。退款、订阅到期或 Apple 撤销交易后，相应 Pro 权益可能被收回。
6. 本地保存、导出与备份
项目和来源图片副本默认保存在设备上的 App 数据中。你应自行保留重要来源文件和导出成品的备份。删除项目、卸载 App、设备损坏、系统清理或备份失败可能导致本地内容无法恢复。保存到照片、Mac 文件或第三方服务的副本由你在对应位置管理。
7. 自动处理结果
AI 高清、一键抠图、自动取样、配色和图案生成可能因图片质量、边缘、透明度、设备性能或参数不同而产生不完整或不符合预期的结果。请在发布、打印或商业使用前自行检查结果，并在需要时使用 App 的调整或修边能力。
8. 可接受使用
你不得使用拾纹创作、处理或传播违法、侵权、欺诈、恶意、骚扰或侵犯他人隐私的内容，也不得绕过购买验证、破坏 App、传播恶意代码，或以可能损害 App、Apple、PostHog、其他服务或用户的方式使用本 App。
9. App 与品牌权利
除你的内容外，拾纹 App、代码、界面、名称、Logo、内置设计及相关材料中的知识产权归其合法权利人所有。本条款没有向你转让这些权利。你发送的反馈可由我们用于改进 App，但不会因此取得你随反馈附带的作品所有权。
10. 可用性、变更与责任限制
我们会合理维护 App，但不保证所有设备、系统版本或第三方服务始终可用，也不保证 App 完全无错误或不会中断。Apple 的商店、购买、系统备份、分享和其他平台服务由 Apple 或相应提供方负责。
在适用法律允许的最大范围内，App 按“现状”和“可用”状态提供。对于因不当使用、未备份、来源素材权利问题、第三方服务或超出我们合理控制范围的事件造成的损失，我们不承担责任。任何排除或限制均不影响适用法律下不能被排除的消费者权利。
11. 终止、更新与联系
如果你严重违反本条款，你对 App 的许可可能按 Apple 标准 EULA 终止。停止使用或删除 App 不会自动取消有效订阅。
当功能、购买方式或法律要求发生变化时，我们可能更新本条款，并在本页修改生效日期；重大变化会尽量在 App 内提示。更新后继续使用 App，表示你接受更新后的条款，但法律要求另行同意的情况除外。

1. Acceptance and scope
By downloading, installing, purchasing, or using Shiwen Design, you agree to these Terms of Use. They apply to Shiwen Design 2.2.0 distributed through the Apple App Store on iPhone, iPad, and Mac.
These terms supplement, and do not replace, Apple's Standard End User License Agreement (Standard EULA). The app license, App Store distribution, and Apple's rights as a third-party beneficiary remain governed by the Standard EULA. If terms conflict, the Standard EULA and mandatory consumer law control to the extent applicable.
2. The service
Shiwen is a local-first pattern creation tool. Version 2.2.0 lets you import or capture an image, sample and repeat it with 23 pattern structures, choose palettes and watercolor, oil, or rubbing effects, and use on-device AI HD and one-tap cutout. Depending on the feature and entitlement, you can save local projects or export unit tiles, full patterns, and transparent PNGs.
The current version requires no account and provides no cloud project sync. Features, interface, available structures, and system requirements may change in later versions.
3. License to use the app
Subject to these terms and the Apple Standard EULA, we grant you a limited, non-exclusive, non-transferable license to use the app. You may not copy, sell, rent, bypass purchase or security controls, reverse engineer the app except where law expressly permits it, or use the app to interfere with a device, service, or another person's rights.
4. Source images and output
- You retain the rights you lawfully hold in source images, sampled content, local projects, and output. Shiwen does not claim ownership of that content merely because you use the app.
- You are responsible for having the rights needed to import, process, share, and use source images, including copyright, trademark, publicity, privacy, and other third-party rights.
- Shiwen is a creative tool. We do not guarantee that output is original, eligible for intellectual-property registration, unique, or dissimilar from another person's work.
- Whether output may be used commercially depends on the source-material license, your contribution, and applicable law. Using the app does not grant commercial rights to source material.
Image processing, cutout, AI HD, and pattern rendering run on your device and are not uploaded to Shiwen servers. See the Privacy Policy for details.
5. Pro purchases, subscriptions, and restoration
- Shiwen may offer Lifetime, Monthly, and Annual Pro plans. Products, prices, billing periods, trials, and offer eligibility are those displayed by the App Store and the in-app paywall when you purchase.
- Lifetime is a one-time purchase and does not renew. Monthly and Annual are auto-renewable subscriptions. Unless cancelled at least 24 hours before the end of the current period, Apple will charge your account for renewal.
- You can manage or cancel a subscription in your Apple account subscription settings. Deleting the app does not cancel a subscription.
- Apple processes purchases, renewals, refunds, taxes, trials, and offer-code eligibility under its terms. Refund requests must be submitted to Apple.
- Restore Purchases restores entitlements supported by a verifiable Apple purchase record. Refunds, expiration, or transaction revocation may remove the related Pro entitlement.
6. Local storage, export, and backup
Projects and source-image copies are stored by default in the app's local data on your device. You are responsible for backing up important source files and exported work. Deleting a project, uninstalling the app, device failure, system cleanup, or backup failure may make local content unrecoverable. You manage copies saved to Photos, Mac files, or third-party services in those destinations.
7. Automated results
AI HD, one-tap cutout, automatic sampling, palette mapping, and pattern generation may be incomplete or differ from what you expect depending on image quality, edges, transparency, device performance, and settings. Review output before publishing, printing, or commercial use, and use the app's adjustment or edge-refinement tools when needed.
8. Acceptable use
You may not use Shiwen to create, process, or distribute unlawful, infringing, fraudulent, malicious, harassing, or privacy-invasive content. You may not bypass purchase verification, damage the app, distribute malicious code, or use the app in a way that may harm the app, Apple, PostHog, another service, or another user.
9. App and brand rights
Except for your content, intellectual-property rights in the Shiwen app, code, interface, name, logo, built-in designs, and related materials belong to their lawful owners. These terms do not transfer those rights to you. We may use feedback you submit to improve the app, but do not thereby take ownership of artwork attached to feedback.
10. Availability, changes, and limitation of liability
We will use reasonable care to maintain the app, but do not promise that every device, operating-system version, or third-party service will always be available, or that the app will be uninterrupted or error-free. Apple's store, purchasing, system backup, sharing, and other platform services are provided by Apple or the relevant provider.
To the fullest extent permitted by law, the app is provided “as is” and “as available.” We are not responsible for loss caused by misuse, failure to back up, source-material rights issues, third-party services, or events beyond our reasonable control. No exclusion or limitation affects consumer rights that cannot lawfully be excluded.
11. Termination, updates, and contact
If you materially breach these terms, your app license may terminate under the Apple Standard EULA. Stopping use or deleting the app does not automatically cancel an active subscription.
We may update these terms when features, purchasing, or legal requirements change and will revise the effective date on this page. We will aim to give in-app notice of material changes. Continued use after an update means you accept the updated terms, except where law requires separate consent.
